In Maryland, a person may be charged with drug distribution if they are accused of selling, delivering, or dispensing drugs to others. Possession of drugs in large quantities may be considered possession with intent to distribute, and a person may face the same penalties as they would for drug distribution. Distribution of drugs that are classified as Schedule I or Schedule II controlled substances, such as heroin, methamphetamine, cocaine, or LSD, is a felony offense that carries a maximum sentence of 20 years in prison and a maximum fine of $15,000. Distribution of most other types of controlled substances is a felony that may result in a sentence of up to five years and/or a fine of up to $15,000.
While the state of Maryland has legalized marijuana for possession and use by adults over the age of 21, a person may face drug distribution charges if they sell or distribute marijuana to others without a valid license. Distribution of cannabis is generally classified as a misdemeanor offense with a maximum sentence of three years and/or a maximum fine of $5,000.

- Cannabis: 50 pounds
People who are charged with distribution of or possession with intent to distribute these amounts of drugs will face a mandatory minimum sentence of five years in prison. They may also be fined up to $100,000.
Drug Trafficking Charges in Maryland
Drug trafficking involves the transportation, distribution, or importation of large quantities of controlled substances into the state of Maryland. This is a felony offense, and it will apply if a person is accused of bringing the following amounts of drugs into the state:
- Cocaine: 28 grams
- Heroin, morphine, or opium derivatives: 4 grams
- LSD: 1,000 units
- PCP: 28 grams
- Methamphetamine: 28 grams
- Fentanyl: 4 grams
- Cannabis: 45 kilograms
The penalties for drug trafficking include a maximum prison sentence of 25 years and/or a maximum fine of $50,000. Bringing between five and 45 kilograms of marijuana into the state may result in a penalty of up to 10 years in prison and/or a fine of up to $10,000.
