Drug Possession Charges in Maryland
In Maryland, a person may be charged with drug possession if they are found to have illegal controlled substances in their control or on their person. The severity of the charges can vary based on the type and quantity of the drug. In most cases, small amounts of controlled substances will lead to "simple" possession charges, but larger amounts may lead to charges of possession with intent to distribute. While simple possession is typically considered to be a misdemeanor, accusations of drug distribution will often lead to felony charges.
While Maryland law groups controlled substances into schedules based on their level of risk and potential for abuse, simple possession charges generally apply regardless of the type of drug. As long as a drug is classified as a "controlled dangerous substance" under state law, a person may be charged with possession.
Possessing a controlled substance or administering a controlled substance to someone else without a prescription or outside of a medical practice may lead to drug possession charges. A person may also be charged with this offense if they obtain or attempt to obtain a controlled substance through fraud or deceit, such as by falsifying a prescription. Drug possession is a misdemeanor, and a first conviction may result in a prison sentence of up to one year. A second or third conviction carries a maximum prison sentence of 18 months, and a fourth or subsequent conviction may lead to a maximum sentence of two years. Any drug possession conviction may also result in a fine of up to $5,000.
Marijuana/Cannabis Laws in Maryland
The state of Maryland has legalized marijuana, and adults over the age of 21 can purchase, possess, and use the drug. However, there are strict limits to the amounts that can be possessed. These limits are 1.5 ounces of cannabis flower, 12 grams of concentrated cannabis, such as oils or edibles, or products containing a total of 750 milligrams of THC. Possession of more than the "personal use amount" may result in misdemeanor cannabis possession charges. If convicted of this offense, a person may face a maximum sentence of six months in jail and/or a maximum fine of $1,000. Smoking marijuana in public is considered a civil offense, and a person may be fined a maximum of $50 for a first offense and a maximum of $150 for a second or subsequent offense.
People under the age of 21 may not possess or use any amount of marijuana. If they possess the personal use amount or less, they may be fined up to $100. If they possess up to the "civil use amount" of marijuana, which is 2.5 ounces of cannabis plants, they may be fined up to $250. A minor may also be required to attend a drug education program, receive a substance abuse assessment, and be referred to a drug treatment program, if necessary.
