DUI vs. DWI in Maryland

Maryland law defines two separate, but similar offenses related to drunk or intoxicated driving. These are known as driving under the influence (DUI) and driving while impaired (DWI). The primary difference between these charges lies in the level of impairment penalties that may apply upon conviction.

• Driving under the influence (DUI): This charge will apply when a driver is accused of operating a vehicle with a blood alcohol concentration (BAC) of 0.08 percent or higher. DUI is generally considered to be a more serious offense than DWI due to the higher level of impairment indicated by a BAC that exceeds the legal limit. DUI charges may also apply if a person was under the influence of a controlled substance while driving.
• Driving while impaired (DWI): This offense involves driving after consuming alcohol when a driver's BAC is below 0.08 percent. Even if a driver is not over the legal limit, they may face charges if an officer believes that they exhibit intoxication or are unable to operate a vehicle safely. A person may also be charged with this offense if they are under the influence of a drug or a combination of drugs and alcohol.

Penalties for DUI and DWI in Maryland

First Offense

• DUI: A first-time DUI offender can face up to one year in jail, a fine of up to $1,000, and a six-month driver's license revocation. If the person was transporting a minor in their vehicle at the time of the offense, they may face a two-year sentence and/or a fine of up to $2,000.
• DWI: For a first-time DWI, the penalties include up to 60 days in jail, a fine of up to $500, and a six-month driver's license suspension. If a minor was in the vehicle, a sentence of up to one year and/or a fine of up to $1,000 may apply.

Second Offense

• DUI: For a second offense committed within five years, a person may be sentenced to up to two years in jail, fined up to $2,000, and have their driver's license revoked for up to one year. If the person had a BAC of .15 percent or higher, their license may be suspended for nine months. If the person had a minor in their vehicle, they may face a sentence of three years and/or a fine of up to $3,000.
• DWI: A second DWI conviction can result in up to one year in jail, a fine of up to $500, and a driver's license suspension for nine months to one year. If a person was transporting a minor passenger, they may face a sentence of up to two years and/or a fine of up to $2,000.

Subsequent Offenses

A third DUI or DWI offense that occurs within five years of a previous conviction may result in a sentence of up to five years and/or a fine of up to $5,000. A fourth or subsequent offense may result in a sentence of up to 10 years and/or a fine of up to $10,000.
